Translation Central Terms & Conditions for Translation Contractors (Translators)

I. Situación Laboral

  1. Por el presente confirmo que soy un trabajador independiente y que obraré como tal para todos los servicios que provea a La Compañía. Entiendo que NO soy empleado de La Compañía y acuerdo a lo siguiente:
  2. Soy responsable por todos los productos y servicios brindados por mi persona, o por la empresa que represento.
  3. La Compañía NO devengará ningún tipo de retención impositiva de mis honorarios, sino que informará mis honorarios brutos según lo exijan las normas del país, el estado/la provincia o el municipio. Por lo tanto, soy responsable por todo impuesto gravado que se aplique a mis honorarios brutos.
  4. La Compañía podrá, en cualquier momento, poner fin al uso de mis servicios sin causa alguna y sin mayor obligación, excepto por el pago de los honorarios adeudados por servicios provistos con anterioridad a la fecha de rescisión del acuerdo.
  5. NO estaré asegurado con las pólizas de seguro de La Compañía (incluidas, pero no limitadas a la compensación por: Discapacidad, Riesgo de Trabajo, Licencia por Enfermedad, Vacaciones, Desempleo, etc.).
  6. El proveer servicios a La Compañía no constituye la violación de un acuerdo que yo haya celebrado con un tercero.
  7. Luego de haber aceptado el trabajo, no solicitaré a La Compañía ningún adelanto de dinero, salvo el que haya sido acordado de antemano, ni tampoco el pago de dinero antes de que se hayan cumplido 7 días desde que el trabajo finalizado fuere entregado.
  8. Entiendo que Translation Central procesará los pagos en forma electrónica a través de PayPal o Moneybookers. Es mi responsabilidad abrir una cuenta en PayPal o Moneybookers y proveer a Translation Central de los detalles adecuados para facilitar el pago. .
  9. Notificaré a La Compañía inmediatamente si mis detalles de contacto (los que incluyen los datos postales, de mi hogar o mi teléfono celular y correo electrónico) se ven modificados..

II. Legalidad

  1. I agree to provide services in accordance with The Company's specifications, to complete all assignments previously accepted by me and to have my work reviewed by The Company and/or an independent third party.
  2. I understand that by accepting any translation project from Translation Central, I will take all possible steps to ensure that the translated work is returned within the agreed submission deadline. In case I do not submit the translated work on time, The Company has full right to reduce any agreed payment of 5% per working day of delay, up to a maximum of 100%. If I am aware that I will be unable to submit the translated work on time, I will inform The Company in writing immediately.
  3. I understand that only under extreme circumstances and by previous written agreement with The Company, can deadlines be extended.
  4. If it is determined that I have returned sub-standard or incomplete work, The Company has the right to withhold and/reduce payment according to the level of inaccuracy without any prior notice. If there is evidence that the quality of the translated work is below standard The Company has the right to terminate the contract with me.
  5. I understand that during an assignment I shall report to a representative of The Company and provide summaries of my services upon request.
  6. I will submit all undertaken work - fully completed, at the time specified by The Company on the agreed completion day via email, fax or in person to a representative of The Company.
  7. When working on a computer, I will save my work every 15 minutes and will keep a hard copy on separate computers or CDs to avoid any loss of work done. I will also retain 1 soft copy of my completed work for up to 15 days after the date of submission. I am responsible for any loss of work due to my negligence, power failure, computer virus, theft or loss of my computer or any other technical cause. .
  8. In the event The Company authorizes me to liaise with the client for clarification purposes I will not initiate or engage any discussion of fees, payments or salaries with the client. If the client initiates such a discussion, I will explain that I cannot discuss this with them and I will refer them to The Company. I understand that any poaching of clients will result in civil action, and the immediate cancellation of the contract with The Company.

III. Confidencialidad y Propiedad de la Información

  1. La Compañía considera a la confidencialidad como un requisito esencial en todos los aspectos de sus operaciones. No discutiré las tarifas que reciba por los servicios prestados con los representantes de ninguna organización salvo la de La Compañía.
  2. Acuerdo mantener estricta confidencialidad de todo documento e información que me sea brindado durante el transcurso de mi asociación con La Compañía, sea en forma directa o indirecta. Acuerdo que durante el transcurso de este Acuerdo o en cualquier momento posterior al mencionado, no revelaré de ninguna manera cualquier tipo de información confidencial que me haya sido enviada por La Compañía.
  3. Entiendo que toda la información que me es enviada es propiedad de La Compañía y que es contrario a la política de dicha compañía y una violación de este acuerdo el intentar contactar a cualquier cliente en forma directa, cliente que fue referido por La Compañía, sin previo consentimiento por escrito por parte de la administración de La Compañía.
  4. No induciré ni intentaré influenciar, directa o indirectamente, a ningún empleado y/o prestador de servicios que se encuentre trabajando para La Compañía para que finalice su empleo o asociación con La Compañía.
  5. In the event that any documents and/or all other types of materials prepared by me in the performance of my services for The Company, include material subject to copyright protection - such materials have been specially commissioned by The Company and they shall be deemed "work for hire". To the extent that any such materials do not qualify as "work for hire" under applicable law, and to the extent they include elements which are subject to copyright, patent, trade secret, or other proprietary rights protection, I hereby assign to The Company all right, title, and interest in and to all such materials. To the extent that I have any rights in the same, I hereby waive all enforcement of such rights .
  6. Entiendo que la violación de este acuerdo de confidencialidad resultará en acciones disciplinarias que podrán incluir ramificaciones legales. Si en cualquier momento presencio a un empleado o a otro prestador de servicios hablando acerca de información confidencial, informaré de dicho asunto a un administrador o al director de La Compañía.

IV. Disposiciones Varias

    Legalidad
  1. En caso de una disputa, acuerdo que este acuerdo se regirá por las leyes de Inglaterra y Gales..
  2. Soy plenamente consciente de que este acuerdo permanecerá en vigencia por hasta 2 años más de la última vez que hubiese prestado mis servicios a La Compañía.
  3. La Compañía no tiene obligación alguna de ofrecerme proyectos o labores particulares, y no tengo ninguna obligación de aceptar proyectos o labores particulares.
  4. Entiendo que este acuerdo sólo puede ser modificado por escrito.

    • when I accept it by filling in the Agreement Form forwarded to me by The Company at the time of The Company's offer and submitting it by email to The Company and/or
    • when I check the box on The Company's website during the registration process.
  • Consentimiento al Acuerdo

    Al completar y presentar a La Compañía el Formulario de Aceptación que me ha sido enviado, al momento de la oferta, acuerdo que entiendo completamente las condiciones y sus consecuencias y acuerdo y me obligo a obedecer los Términos y Condiciones incluidos en el presente Acuerdo.
